Terms of Service

These Terms of Service ("Terms") govern your use of the Momentum scheduling platform operated by Momentum ("we", "us", or "our"). By creating an account or using our services, you agree to these Terms.
1. Definitions
- "Platform" refers to the Momentum web application, including the admin panel and booking widget.
- "Business" refers to the car detailing business that subscribes to Momentum.
- "Customer" refers to the end user who books services through a Business's booking widget.
- "Subscriber" refers to the Business owner or authorized representative who manages the Momentum account.
2. Account Registration
To use Momentum, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.
3. Description of Service
Momentum provides a scheduling and booking management platform for car detailing businesses. The platform includes:
- An admin panel for managing services, team members, territories, and bookings
- A public booking widget for accepting customer appointments
- Travel time calculation between service locations
- Payment processing for 10% booking deposits through Stripe
- SMS and email notifications for booking events
4. Subscription and Billing
Momentum is offered as a subscription service with multiple pricing tiers. By subscribing, you agree to:
- Pay the applicable subscription fee on a monthly or annual basis, depending on the plan selected.
- Subscription fees are billed in advance and are non-refundable except as described in our Refund Policy.
- We may change pricing with 30 days' notice. Changes take effect at the start of your next billing cycle.
- Your subscription will automatically renew unless you cancel before the end of the current billing period.
5. 10% Deposit Policy
Momentum facilitates the collection of a 10% deposit from Customers at the time of booking. As a Subscriber, you understand and agree that:
- The 10% deposit is collected through Stripe and deposited into your connected Stripe account.
- You are responsible for setting your service pricing and understanding the deposit amounts that will be charged to your Customers.
- Deposit refunds to Customers are managed through your Stripe account and are your responsibility, subject to your own cancellation policies.
- Momentum does not hold or manage deposit funds — they are transferred directly to your Stripe account.
6. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or to violate any applicable laws
- Attempt to gain unauthorized access to the platform or other users' accounts
- Use the platform to send spam, unsolicited messages, or harassing communications
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Interfere with or disrupt the platform's infrastructure or other users' access
- Use automated tools to scrape data or overload the platform
7. Intellectual Property
The Momentum platform, including its design, code, features, and documentation, is owned by Momentum and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your business operations.
You retain ownership of all data you upload to the platform, including business information, customer data, and service configurations.
8. Data and Privacy
Your use of the platform is also governed by our Privacy Policy. As a Subscriber who collects Customer data through the booking widget, you are responsible for:
- Complying with applicable data protection laws in your jurisdiction
- Informing your Customers about how their data is collected and used
- Responding to data access or deletion requests from your Customers
9. Limitation of Liability
To the maximum extent permitted by law, Momentum shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to:
- Lost revenue or profits due to scheduling errors or downtime
- Inaccurate travel time calculations
- Payment processing issues handled by Stripe
- Delivery failures of SMS or email notifications
Our total liability for any claim shall not exceed the amount you paid for the platform in the 12 months preceding the claim.
10. Termination
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your account remains active until the end of the current billing period
- You retain access to your data for 30 days after the subscription ends
- After 30 days, your data may be permanently deleted
We may suspend or terminate your account if you violate these Terms, with notice where practicable.
11. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or that travel time calculations will be perfectly accurate.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the platform after changes constitutes acceptance of the updated Terms.
